Private Event Terms of Service: Make At Rosie Community Makerspace
These terms and conditions govern the reservation and use of the Make At Rosie Community Makerspace (C&C Machine, LLC) for private events. By confirming your booking, you (the "Customer") agree to be bound by these terms.
Booking, Payment, and Finalization
Booking Finalization: Your reservation is not finalized and your event is not scheduled until payment for the minimum booking fee (and any required deposit) is received in full.
Minimum Booking Fee: A $300 minimum booking fee is required to reserve the space.
Remaining Balances: Any remaining balances for services rendered, supplies used, or time overages will be calculated after the event.
If a credit card is on file, any remaining balances will be processed within two weeks after your event date.
If a credit card is not on file, the remaining balance is due within 30 days of the event date.
Credit Card Authorization (Damage Hold): The Customer authorizes Make At Rosie to charge the credit card on file for the amount of any balances due, including pre-approved changes, added gratuities, or costs associated with damages (see Section 4). The Customer affirms they are the rightful owner of the card and have full permission to use it accordingly.
Cancellation and Rescheduling Policy
All cancellations must be made in writing (email to hello@makeatrosie.com) and you must receive a confirmation email from Make At Rosie.
31 Days or More: Full Refund of all fees paid to date.
15-30 Days: Fee is converted to a non-transferable six-month credit for a future booking or space rental.
14 Days or Less / No-Show: Full Forfeiture of the booking fee. No refund or credit will be issued
Rescheduling: Rescheduling is permitted at no fee if the request is made 15 days or more in advance and dates/staffing align. Requests to reschedule 14 days or less prior to the event will be treated as a full cancellation and forfeiture of the original fee.
Makerspace Cancellation (Force Majeure): If Make At Rosie must cancel due to unforeseen circumstances, the client is guaranteed a choice between a full refund or an unexpired credit.
Operations, Setup, and Cleanup
Arrival and Setup: The Customer may arrive up to 30 minutes early for setup and staging.
Food and Beverages: The Customer may bring any food or beverages (Alcohol is permitted if all adults are over 21). Make At Rosie provides a water cooler and microwave; no refrigerator is available for public use.
Decorations: The Customer may decorate the space; however, no tape or permanent adhesive is permitted on the walls or equipment.
Clean Up: The Customer must leave the space in the condition it was found. This includes:
Vacuuming and sweeping the event area (vacuum located in the bathroom).
Taking out all garbage (dumpsters located to the right of the unit).
Damage to Property and Cleanup Fees
Damage Responsibility: The Customer is solely responsible for any and all damage to the Makerspace premises, including tools, equipment, fixtures, and furniture, caused by the Customer or their guests.
Damage Charges: Make At Rosie reserves the right to charge the authorized credit card for the full cost of repair or replacement of any damaged property, plus any associated labor or administrative fees.
Excessive Cleaning: If the space requires excessive cleaning beyond standard vacuuming and sweeping (as determined by Makerspace staff), the Customer will be charged a cleaning fee of $100 per hour against the authorized card.
Rules of Conduct, Safety, and Right to Refuse Service
Safety Compliance: The Customer agrees that they and all guests will strictly adhere to all verbal and written safety instructions provided by Make At Rosie staff, particularly when operating any machinery or tools.
Prohibited Activities: The following are strictly prohibited on the premises: illegal activities, consumption of illegal substances, bringing firearms or weapons, and disruptive or aggressive behavior.
Right to Terminate Event: Make At Rosie reserves the right to immediately terminate the event and require the Customer and all guests to leave the premises if:
Maximum occupancy is exceeded.
Any person engages in illegal, unsafe, excessively disruptive, or dangerous conduct.
Staff instructions regarding safety or conduct are ignored. In the event of termination due to misconduct, the Customer will receive no refund or credit.
Insurance and Certification
Make At Rosie carries general liability insurance through C&C Machine, LLC. Companies or locations can be listed as "certificate holders" or added to these policies. Please email hello@makeatrosie.com for more information and to request documentation.
By hiring Make At Rosie, the Customer and their guests acknowledge the inherent risks associated with a community workshop environment, including exposure to tools, machinery, dust, chemicals, and potentially hazardous materials.
Acceptance of Terms: The Customer acknowledges they have had the opportunity to read, understand, and accept all these terms and conditions.
Waiver and Release: The Customer (for themselves, their guests, executors, and assigns) hereby waives, releases, and discharges Make At Rosie, C&C Machine, LLC, its owners, affiliates, employees, and volunteers from any and all liability for personal injury, disability, death, property damage, property theft, or any other losses or actions which may hereafter accrue to the Customer or their guests by virtue of their voluntary presence and participation at the Makerspace.
Indemnification: The Customer assumes all risks of hosting this event and agrees to indemnify, defend, and hold harmless Make At Rosie and its affiliates against any claims, lawsuits, costs, damages, and expenses (including attorney’s fees) brought by any of their guests arising from or related to the event. The Customer agrees to use their own homeowners or commercial liability insurance to cover any such liability claims, should the issue arise.
Intellectual Property and Use of Media
Ownership of Work Product: Any intellectual property, inventions, designs, or physical goods created by the Customer or their guests during the event remain the sole and exclusive property of the Customer or the respective guest. Make At Rosie claims no ownership rights to projects or products made during the booking time.
Use of Event Photography: The Customer grants Make At Rosie and its affiliates the irrevocable right to use, reproduce, publish, and distribute photographs, video recordings, or other media captured by Makerspace staff during the private event for marketing, promotion, social media, and informational purposes without further compensation to the Customer or their guests. The Customer is responsible for notifying any guests who do not wish to be included in photos/video.
Third-Party Vendor Services
Independent Contractors: If the Customer contracts with any third-party vendors (e.g., caterers, photographers, planners, delivery services) to provide goods or services for the event, these vendors are deemed to be independent contractors of the Customer, not of Make At Rosie.
Disclaimer of Liability: Make At Rosie is not liable for any acts, omissions, negligence, equipment failure, or misconduct by any third-party vendor. The Customer assumes all responsibility and liability for all third-party vendors and their staff, and agrees to indemnify and hold harmless Make At Rosie from any claim arising from their actions.
Governing Law and Dispute Resolution
Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of laws principles.
Dispute Resolution: In the event of any dispute arising out of or relating to this Agreement, the parties agree to attempt in good faith to negotiate a resolution. If negotiation is unsuccessful, the parties agree to submit the dispute to binding arbitration in Travis County, in the State of Texas before a single arbitrator under the rules of the American Arbitration Association (AAA).
